STAON Vs Shippers’Council: Court Adjourns Case Till December 15th For Hearing


The Federal High Court sitting in Lagos has adjourned the case between the Nigeria Shippers’ Council (NSC) and Seaports Terminal Operators Association of Nigeria (STOAN) over issues of charges at the Nigerian ports to 15th December, 2014 for hearing.
Presiding judge, Justice Buba Ibrahim said yesterday that the case should be adjourned to the aforementioned date, even as he urged counsel to co –defendants in the case; the Shippers Association of Lagos State (SALS); Barrister Osuala Nwagbara to submit all necessary documents within 48 hours.
Initially, the judge had told the parties that the case would hold on Friday, but, upon a mutual agreement by all the parties, he agreed to adjourn to Monday the 15th of December, 2014.
Meanwhile, Counsel to SALS; Barrister Osuala Nwagbara told journalists that the Shippers Association of Lagos State had filed an application to be joined in the case, and added that, "we were given 48 hours to file our reports, all our processes and all the effecting issues that aris from all local ports charges, coming from the terminal operators will be resolved and we will do our best to meet up the order of the court".
Also speaking with the media after the sitting, counsel to the Nigeria Shippers Council; Barrister Emeka Akabogu said that the court adjourned the case to Monday next week , in order to accommodate parties seeking to be joined in the case.
According to him," we are comfortable with the development and there is nothing wrong for another party to join us in the case because we want to ensure that justice is done for everybody"
On his part counsel to STOAN, Femi Atoyebi, SAN said that adjournment of the case till Monday the 15th 2014 is alright by him.
He said for another party to partake in a case was alright, because according to him, "it is said that if another party wants to come in let them come in so as to avoid multiplicity of suit and if the court doesn't allow them to come in , then it will sue separately, so it is better for us once and for all and close it , which was the major reason behind the adjournment".http://shippingposition.com.ng/article/staon-vs-shippers%E2%80%99council-court-adjourns-case-till-december-15th-hearing
